This is the licence under which you install and use Lopari on your computer. It is short, in plain English, and free. Use Lopari for what it is for, accept that it is provided without warranty, and remember that what you do with games you own remains your responsibility.

1. Parties and acceptance

This End User Licence Agreement (the "Licence") is between you (the "User") and the individual developer publishing the Lopari software under the itsloopyo handle (the "Licensor"). By installing, copying, or using the Lopari desktop application (the "Software"), you accept this Licence. If you do not accept it, do not install or use the Software.

2. Licence grant

The Licensor grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the Software on personal computers you own or control, for non-commercial personal use, subject to the terms of this Licence.

4. Reverse engineering

You may not decompile, disassemble, or reverse engineer the Software, except to the extent that such activity is expressly permitted by applicable law notwithstanding this restriction (for example, the limited rights to decompile for interoperability granted to lawful users by section 50B of the Copyright, Designs and Patents Act 1988). Where you rely on a statutory right, you must first request the information you need from the Licensor; reverse engineering is permitted only if that request is refused or not answered within a reasonable time.

5. Your games and your machine

You are solely responsible for the games you launch and the mods you choose to install with the Software. Modifying a PC game can breach that game's own end user licence agreement, can void warranties, and can in some titles result in penalties imposed by the publisher (including bans from multiplayer services). The Software and any community mods it can install are intended for single-player camera and immersion changes on titles where such modification is tolerated. The decision to install any mod against any specific title is yours.

You represent that your use of the Software with any particular game complies with the terms applicable to that game.

6. Third-party mods and game content

The Software can install community-authored mods that are published under their own licences by their own authors. Those mods modify the behaviour of a game that runs on your machine; they do not redistribute any game's copyrighted assets. The Licensor makes no warranty regarding any specific mod, any specific game version, or the interaction between the two. The remedy for a misbehaving mod is to uninstall it.

All game titles, trademarks, and logos referenced in or accessible through the Software are the property of their respective owners. They are referenced solely to identify games the Software can work with. The Software and the Licensor are not affiliated with, endorsed by, sponsored by, or otherwise associated with any game publisher, developer, storefront, hardware vendor, or trademark holder.

7. Supporter features

The Software may offer optional features that are unlocked while you are an active supporter of the project on Patreon. By linking a Patreon account, you authorise the Software to query Patreon's API for your supporter status only. Supporter-only features may change in scope, availability, or pricing at any time without notice. Supporter status is a thank-you for backing the project, not a paid product, and pledges are not refundable by the Licensor; refund requests go to Patreon directly. Your relationship with Patreon, including billing, is governed by Patreon's own terms.

8. Updates

The Software may check for and install its own updates, including security fixes, bug fixes, and new features. You can disable update checks in the Software's settings. The Licence applies to all updated versions you choose to install.

9. Privacy

The Software runs locally on your machine and does not send telemetry, analytics, or any other data about you to the Licensor. The full Privacy Policy is at lopari.app/privacy.

10. Intellectual property

The Software, including its source code, compiled binaries, name, logo, and visual identity, is the property of the Licensor and is protected by copyright and other intellectual property laws. Except for the limited rights granted in section 2, this Licence does not transfer to you any ownership of or rights in the Software.

11. No warranty

The Software is provided as is and as available, without warranty of any kind, express or implied, including without limitation the implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement. The Licensor does not warrant that the Software will be uninterrupted, error-free, or compatible with any particular game version, operating system patch, or hardware configuration.

12. Limitation of liability

To the maximum extent permitted by law, the Licensor is not liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of game saves, loss of access to multiplayer features, account suspensions imposed by third parties, downtime, or hardware issues, arising from your use of the Software.

The Licensor's total aggregate liability for any claim arising out of this Licence or your use of the Software will not exceed £50.

Nothing in this Licence excludes or limits the Licensor's liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law.

13. Your statutory rights as a consumer

If you are a consumer under the laws of England and Wales, nothing in this Licence affects your statutory rights, including any rights you may have under the Consumer Rights Act 2015 in relation to digital content supplied free of charge.

14. Termination

This Licence is effective until terminated. You may terminate it at any time by uninstalling the Software. The Licence will terminate automatically without notice if you breach any of its terms. On termination, you must stop using the Software and remove all copies of it from your computer. Sections 4, 6, 10, 11, 12, and 13 survive termination.

15. Changes

The Licensor may publish revised versions of this Licence from time to time. Changes apply to versions of the Software released after the change. The "last updated" date above will be moved when a material change is made.

16. Governing law and jurisdiction

This Licence is governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any dispute arising out of or in connection with this Licence, except that, if you are a consumer resident in another part of the United Kingdom, you may also bring proceedings in the courts of the part of the United Kingdom in which you reside.
